Terms of Use
These Terms of Use govern access to and use of the MorfoFit mobile application and related services provided by Elena Magoula. By creating an account or using MorfoFit, you agree to these Terms and the Privacy Policy.
1. Eligibility and account registration
You must have legal capacity to accept these Terms. If local law requires parental or guardian authorisation, you may use MorfoFit only with that authorisation. Registration information must be accurate and kept current.
You are responsible for safeguarding your password and for activity performed through your account. Notify us promptly at [email protected] if you suspect unauthorised access.
2. Fitness and health responsibilities
Exercise involves inherent risks. Before beginning or changing an exercise or nutrition programme, obtain appropriate professional advice, especially if you are pregnant, injured, taking medication or have a medical condition, symptoms or physical limitations.
Stop exercising and seek appropriate assistance if you experience pain, dizziness, faintness, breathing difficulty or another concerning symptom. In an emergency, contact the local emergency services. You remain responsible for choosing activities suitable for your condition, environment and abilities.
3. MorfoFit content and features
MorfoFit may provide workouts, articles, recipes, videos, schedules, progress tools and related educational content. Content is general in nature and may not be suitable for every user. Features and content may be corrected, updated, replaced or discontinued where reasonably necessary.
4. Subscriptions and automatic renewal
Premium features may be offered through auto-renewable subscriptions purchased from Apple App Store or Google Play. Before purchase, the application displays the subscription title, billing period and store-supplied price.
- Payment is charged to the Apple ID or Google Play account used for the purchase.
- The subscription renews automatically unless cancelled through the relevant store before renewal.
- Subscription management, cancellation, billing and refund requests are handled through Apple or Google under their applicable terms and mandatory consumer law.
- Deleting the MorfoFit account does not cancel the store subscription. Cancel the subscription separately through the relevant store settings.
- Deleting the account terminates access to account-based MorfoFit features, including premium access associated with that account.
Apple's Standard Licensed Application End User License Agreement and the applicable Apple or Google store terms may also apply. Mandatory consumer rights are not limited by these Terms.
5. Acceptable use
You must not:
- Use MorfoFit unlawfully, fraudulently or in a manner that harms another person.
- Attempt to bypass subscriptions, access controls or security mechanisms.
- Reverse engineer, scrape, copy, redistribute or commercially exploit the application or its content except where applicable law expressly permits it.
- Upload malicious code, infringing material or content that violates another person's privacy or rights.
- Interfere with the service, automated systems, networks or other users.
- Transfer, sell or share account credentials.
6. Intellectual property
MorfoFit, its software, design, branding and original content are protected by intellectual-property laws. Subject to these Terms, you receive a limited, personal, non-exclusive, non-transferable and revocable right to use the application for private purposes.
Ownership of third-party materials remains with the relevant rights holder. No licence is granted beyond what is necessary to use MorfoFit as intended.
7. User-provided material
Where MorfoFit permits profile images or other uploads, you must have the right to provide them. You grant MorfoFit a limited licence to host, process and display that material solely to operate the requested feature. This licence ends when the material or account is deleted, except for temporary backup retention or lawful retention described in the Privacy Policy.
8. Availability and changes
We aim to provide a reliable service but do not guarantee uninterrupted or error-free availability. Maintenance, security incidents, store outages, network conditions and third-party services may affect operation. We may modify the application where reasonably necessary for security, compliance, compatibility or product development.
9. Suspension and termination
We may restrict or terminate access where reasonably necessary to address fraud, serious misuse, security threats, legal obligations or material breach of these Terms. Where appropriate, we will provide notice and an opportunity to respond.
You may stop using MorfoFit at any time and may permanently delete your account in the application or at https://morfofit-api-production.up.railway.app/delete-account. Account deletion is governed by the Privacy Policy.
10. Disclaimers and liability
To the maximum extent permitted by law, MorfoFit is provided on an “as available” basis. We do not warrant that general fitness content will produce a particular physical, health or aesthetic result.
Nothing in these Terms excludes liability that cannot lawfully be excluded, including liability arising from fraud, wilful misconduct, gross negligence, death or personal injury where such exclusion is prohibited, or mandatory consumer-protection rights.
Subject to the preceding paragraph, we are not liable for indirect or unforeseeable losses, loss caused by disregarding health warnings, unsuitable exercise choices, unauthorised account use attributable to the user's failure to protect credentials, or failures outside our reasonable control.
11. Privacy
Personal data is handled as described in the Privacy Policy. The policy also explains data retention, account deletion and privacy rights.
12. Governing law and disputes
These Terms are governed by Greek law, without depriving consumers of mandatory protections available under the law of their habitual residence. Courts competent under applicable consumer and procedural law retain jurisdiction.

13. Changes to these Terms
We may update these Terms to reflect changes in the service, law or store requirements. The current version and effective date will be published at this URL. Material changes will be communicated through the application or another appropriate channel.
